EXECUTIVE LENS STUDIO SESSION BOOKING TERMS AND CONDITIONS

By scheduling an appointment with Executive Lens, the client agrees to the following Terms and Conditions.

Appointment Reservation

Appointments are reserved upon completion of the booking process and payment of any required booking fee, session fee, or deposit.

Client Responsibilities

Clients are responsible for reviewing all information provided by Executive Lens, including appointment confirmations, studio directions, preparation instructions, scheduling details, pricing information, and studio policies.

Clients are responsible for ensuring that Executive Lens has accurate contact information, including a current mobile telephone number capable of receiving calls and text messages, for the purpose of communicating appointment reminders, directions, schedule updates, weather-related notices, access instructions, and other time-sensitive information.

For appointments booked on behalf of another individual, organization, employee, student, family member, or group participant, the person making the booking is responsible for providing accurate contact information for the subject and ensuring that the subject receives all relevant instructions, directions, updates, and communications from the studio.

Executive Lens shall not be responsible for missed appointments, delays, communication failures, or other issues resulting from inaccurate, incomplete, outdated, blocked, filtered, or unavailable contact information.

Arrival and Preparation

Clients should arrive at their scheduled appointment time, not significantly earlier.

Clients are responsible for arriving camera-ready, including appropriate clothing, grooming, hair styling, and makeup, if desired.

The studio provides a dressing area and preparation space as a convenience. Time spent changing clothing, grooming, makeup application, or preparation counts toward the scheduled session time.

Rescheduling and Cancellation

One reschedule may be made online with at least 48 hours' notice.

Additional reschedule requests may require studio approval and may be subject to a fee.

If illness, emergency, or unexpected circumstances arise, clients should contact the studio as soon as possible by phone, text, or email.

Repeated cancellations, no-shows, or excessive rescheduling may result in forfeiture of booking fees, cancellation of future appointments, or both.

No-Shows and Late Arrivals

A "no-call, no-show" occurs when a client fails to attend a scheduled appointment and does not notify Executive Lens of their inability to attend before the scheduled appointment time.

A no-call, no-show shall result in forfeiture of any booking fee, deposit, or session fee paid and cancellation of the appointment.

Late arrivals may result in reduced session time. Sessions will generally end at the originally scheduled time to avoid impacting other scheduled appointments.

Satisfaction Guarantee

For first-time clients booking a Signature Session or Deluxe Portrait Session, Executive Lens offers a satisfaction guarantee. If, during the session, the client determines that the images are not meeting expectations and elects not to continue, the session fee will be refunded and no images will be delivered.

Once images have been selected, delivered, downloaded, licensed, purchased, or used, the satisfaction guarantee no longer applies.

Image Purchases

Unless expressly stated otherwise in the session description, booking confirmation, written proposal, invoice, or other written agreement, session fees compensate Executive Lens for the photographer's time, expertise, studio facilities, equipment, and related services, but do not include any finished images.

Finished images are purchased separately on a per-image basis at the studio's then-current rates.

Certain session packages include one or more finished images. When images are included, the number of included images will be identified in the applicable package description, booking page, proposal, invoice, or written agreement.

Only those images specifically identified as included are provided as part of the package price. Additional selected images may be purchased separately at the applicable per-image rate.

No usage rights are granted until the corresponding image has been purchased or otherwise included as part of a package and delivered by Executive Lens.

Image Selection and Delivery

Unless otherwise specified, purchased images will be delivered as high-resolution JPEG files with standard studio processing and retouching.

Images are delivered in the studio's standard style, crop, lighting, color treatment, and retouching approach.

Special editing requests, alternate crops, custom backgrounds, additional retouching, image composites, or other modifications may incur additional fees.

Delivery timelines are estimates and may vary based upon workload, holidays, technical considerations, or the scope of requested work.

Retouching

When retouching is included with a session or image purchase, the delivered image will receive the studio's standard retouching treatment and will be provided as-is. The style and extent of retouching are determined by Executive Lens and are intended to provide a natural, professional appearance consistent with the studio's work.

Clients seeking additional modifications, advanced retouching, beauty retouching, composite work, body reshaping, extensive wardrobe corrections, background alterations, or other specialized editing may request additional retouching services from Executive Lens for an additional fee, subject to availability.

Clients are also welcome to engage the services of a professional retoucher of their own choosing after image delivery. Executive Lens does not require that additional retouching be performed by the studio and makes no representations regarding the quality, style, or results of work performed by third-party retouchers.

Any modifications performed by third parties are the responsibility of the client and the third-party retoucher.

Team and Event Headshot Services

Executive Lens provides a variety of team, corporate, conference, association, healthcare, educational, and special-event headshot services. Because the scope and objectives of these projects vary considerably, the number of images provided, image selection process, proofing method, retouching level, delivery specifications, turnaround time, usage rights, and other project-specific details will be defined in the applicable proposal, quote, agreement, or event description provided to the client.

Unless expressly modified in writing, all Executive Lens terms, conditions, policies, scheduling provisions, satisfaction guarantees, limitations of liability, and other applicable studio policies remain in effect for team and event headshot services.

In the event of a conflict between these general terms and a written proposal, quote, or agreement prepared specifically for a team or event photography project, the project-specific agreement shall govern only those items expressly addressed therein. All remaining terms and conditions shall remain in full force and effect.

For organizations utilizing Executive Lens for employee, team, make-up, replacement, or new-hire headshots, subjects seeking images that match the organization's established team style should schedule through the designated company calendar or coordinate with Executive Lens in advance. Consistent lighting, background, cropping, retouching, and overall appearance can generally be maintained when appointments are booked through the designated process. Sessions booked independently without prior coordination may not qualify for team-matching specifications or pricing.

Appointment Confirmation

As part of Executive Lens' scheduling process, appointment details, directions, and any last-minute updates are reconfirmed by email and/or text message approximately one to two days before the scheduled session.

If a subject has not received such a confirmation message before their appointment, the subject needs to contact the studio to verify the appointment details. This helps ensure that scheduling information has been received correctly and provides an opportunity to resolve any unexpected communication or scheduling issues before the session.

Copyright and Usage Rights

Copyright in all photographs remains the exclusive property of Executive Lens.

Clients receive usage rights only for images that have been purchased or are specifically included as part of a purchased package and subsequently delivered by Executive Lens.

No usage rights are granted for proof images, preview images, watermarked images, screenshots, unselected images, rejected images, or any photographs not specifically delivered by Executive Lens.

Unless otherwise agreed in writing, delivered images may be used by the client for personal, professional, editorial, business, marketing, promotional, and social media purposes.

Photographer Portfolio Use

Executive Lens may use photographs created during the session for portfolio display, studio promotion, competition, education, training, website content, blog posts, social media, printed materials, and related business purposes. Such use is occasional in nature, and only a small percentage of sessions are ever considered for promotional or portfolio purposes.

Clients requesting confidentiality, privacy restrictions, non-disclosure of images, or limitations on promotional use should clearly indicate those requirements in the Notes to Studio section of the booking form at the time of booking.

Executive Lens will make reasonable efforts to honor requested restrictions that are communicated in advance. Such restrictions may affect the future handling and availability of session images and may limit the ability of either the studio, the client, or both to select, prepare, retouch, publish, archive, license, distribute, revisit, or otherwise work with additional images from the session in the future.

Limitation of Liability

While Executive Lens will make every reasonable effort to provide professional photography services and deliver agreed-upon images, the studio's total liability for any claim, loss, dissatisfaction, delay, technical failure, equipment malfunction, illness, acts of nature, venue-related issue, scheduling issue, or other circumstance arising from or relating to the engagement shall be limited to the amount actually paid by the client.

The client's sole and exclusive remedy shall be a refund of amounts paid.

In no event shall Executive Lens be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost business opportunities, emotional distress, reputational harm, travel costs, employee time, or third-party expenses.

Studio Policies

Executive Lens reserves the right to refuse service, terminate a session, or cancel an appointment in cases involving unsafe conditions, abusive behavior, harassment, illegal activity, or conduct that interferes with normal business operations.

Guests are welcome when appropriate but may be limited based on space, safety, or session requirements. Coordinate ahead with the studio.

Minors must be accompanied by a parent or legal guardian.

Acceptance

By completing a booking, submitting payment, or attending a scheduled session, the client acknowledges that they have read, understood, and agree to these Terms and Conditions.
